NỌX TERMS
Terms of Use and Support for the NỌX Project
This document describes the general principles governing the use of the NỌX project, its public materials, website, communication solutions, software components, downloads, open resources, and mechanisms for voluntary project support.
NỌX is an independent project focused on the development of secure communication, digital autonomy, privacy, decentralization, and resilient means of communication between people. The public NỌX website is an informational and presentation part of the project and does not represent the full scope of the NỌX system.
The foundation of the project consists of its architectural principles, including an orientation toward decentralization, communication solutions, software components, research approaches, infrastructure elements, and applied developments created to ensure free, resilient, and highly confidential communication. The project may use modern network technologies, applied mathematical methods, cryptographic approaches, architectural solutions, and other technical means that NỌX considers most appropriate for achieving its goals at a given stage of development.
This document is published so that the user may become familiar with the nature of the project, the limits of NỌX’s capabilities, the principles of its use, and the procedure for voluntary support of the project.
1. General Provisions
NỌX is an independent project created and developed in the interests of privacy, secure communication, minimization of digital footprint, decentralization, and reduction of the user’s dependence on imposed intermediaries, advertising models, and excessive data collection.
The NỌX project is not limited to the website alone. The website performs an introductory, informational, and presentation function, while the project itself may include communication solutions, software components, public materials, infrastructure elements, downloads, research and experimental modules, as well as other related tools and developments.
Individual parts of the project may be at different stages of development, testing, implementation, updating, modification, temporary limitation, experimental use, or discontinuation.
2. Purpose of the Project
NỌX is created as a system and environment for secure communication, intended to preserve connection between people without an advertising model, without mandatory subscription dependence as the primary form of access, without excessive collection of personal data, with reliance on decentralized design principles, and without turning the user into an object of observation.
The public NỌX website serves as a means of presenting the project, its philosophy, materials, principles, downloads, and available entry points. The website itself is not a complete reflection of the entire NỌX system and is regarded as the project’s external informational shell.
The communication, software, and infrastructure elements of NỌX may develop, change, be tested, updated, replaced, or be provided gradually depending on technical, organizational, and strategic decisions of the project.
3. Familiarization and Voluntary Use
NỌX does not require the user to perform a separate formal act of accepting terms by pressing an “Accept” button or by entering into a separate agreement in explicit form.
This document is published so that the user may become familiar with the nature of the project, its limits, the principles of its operation, and the boundaries of NỌX’s responsibility.
Continued use of the NỌX project, its website, materials, downloads, communication solutions, or other open components after becoming familiar with this document means that the user understands the general nature of the project, is aware of its features, and independently decides to use it voluntarily and at their own risk.
The user independently determines whether to use the project, through which devices, networks, browsers, operating systems, and software tools, and independently bears responsibility for that choice.
4. “As Is” Principle
The NỌX project, its website, materials, downloads, communication solutions, software components, and other related elements are provided on an “as is” and “as available” basis.
NỌX does not promise uninterrupted, error-free, permanent, universally compatible, or consistently available operation of all its components, materials, downloads, communication solutions, and other elements.
NỌX does not guarantee the absence of technical limitations, interruptions, changes, temporary unavailability, incompatibility with a particular environment, device, browser, operating system, network, provider, or other external conditions.
The project may be changed, updated, reworked, restricted, moved, suspended, or discontinued in whole or in part without prior notice, unless expressly stated otherwise separately.
5. Privacy and Data
NỌX strives for maximum confidentiality and data minimization.
The project architecture is based on the principle that personal data of the user should not be collected or stored within the project itself, unless otherwise expressly stated separately for a specific case or component.
Accordingly, NỌX cannot transfer, disclose, or provide data that it does not possess.
At the same time, the user understands that outside the project itself there may exist third-party environments and entities capable of processing, analyzing, storing, or obtaining access to information independently of NỌX, including browsers, operating systems, devices, networks, internet service providers, hosting infrastructure, routing mechanisms, platforms, external services, and other technical or organizational elements.
NỌX bears no responsibility for the collection, processing, storage, analysis, filtering, blocking, transmission, leakage, or other handling of data carried out by such external entities outside the direct control of the project.
More detailed provisions regarding the project’s approach to data and related matters are contained in the separate Privacy Policy.
6. Limits of Project Control
The user understands that NỌX controls only those elements of the project that are within its own architecture, infrastructure, and actual management.
Everything outside the direct control of NỌX, including the user’s hardware, device, browser, operating system, mobile platform, communication provider, routing, network, external services, domain and hosting levels, as well as other third-party environments, does not fall within the project’s sphere of responsibility.
Even while striving to ensure the highest possible confidentiality, resilience, decentralization, and reliability of communication, the project cannot guarantee the behavior or policies of external entities, systems, and infrastructures that do not belong to NỌX.
7. Permitted Use
The user is expected to use the open and accessible parts of the NỌX project lawfully, in good faith, and without abuse of the project’s infrastructure.
Use of NỌX is not permitted for unlawful activity, interference with the operation of the project, its website, servers, or infrastructure, distribution of malicious code, attacks, automated abuse, attempts to disrupt the functioning of resources, violation of the rights of third parties, or any other actions capable of causing harm to the project, its infrastructure, materials, or other users.
NỌX may restrict access to individual materials, sections, files, downloads, or other project components in cases of abuse, security threats, technical necessity, updating, overload, protection of infrastructure, or for other reasons related to preserving the project’s resilience.
8. Downloads, Software Components, and Experimental Materials
The NỌX project may contain documents, downloads, software components, demonstration solutions, experimental builds, research materials, test tools, and other files.
Unless expressly stated otherwise, such materials are provided for informational review, research, independent study, testing, or use at the user’s own risk.
The user independently decides whether to download, install, launch, use, test, modify, or integrate any files and materials related to the NỌX project.
NỌX bears no responsibility for incompatibility, environmental limitations, local technical failures, characteristics of a device, browser, operating system, network, or other consequences arising from the use of such materials.
9. Project Materials and Rights to Them
Texts, structure, visual elements, names, logos, design, philosophical materials, manifestos, graphic solutions, documents, and other elements of the NỌX project belong to the NỌX project or are used on lawful grounds.
Unless expressly stated otherwise, project materials must not be copied, republished, reworked, distributed, passed off as one’s own, or used in a way that creates a false impression of official affiliation, endorsement, or representation on behalf of NỌX.
Reasonable forms of quotation, linking to the project, introductory and non-commercial mention are permitted provided that meaning is preserved, content is not distorted, and authorship of the project is not appropriated.
If certain materials are published under different terms of use, this must be stated separately.
10. Absence of a Commercial Subscription Model
NỌX is not positioned as a project based on the sale of mandatory subscriptions, imposed paid features, or advertising monetization as its primary form of existence.
The project may develop independently of an advertising model and seeks not to turn the user into a source of commercial profiling.
If special forms of access appear within the project in the future, they must be described separately. Until such indication is made, voluntary support of the project is not regarded as a subscription, purchase of a service, or commercial agreement to provide a guaranteed result.
11. Project Support and Voluntary Donations
NỌX may accept voluntary donations to support research, development, infrastructure, maintenance, project resilience, publications, improvements, and the further development of communication solutions and other related project components.
Such support is a voluntary form of assistance to the project and is not the purchase of a product, subscription, share, license, guaranteed feature, guaranteed implementation period, personal service, or an obligation to provide an individual result.
Support of the project does not grant the user the right to demand implementation of a specific feature, changes to development priorities, special status, exclusive powers, personal support, consultations, individual service, or participation in project governance.
Voluntary support of NỌX does not create an obligation for the project to release a specific update, implement a specific feature, provide a specific result, or comply with any individual deadline at the user’s request.
Donations are accepted as a form of support for the independent development of NỌX, and not as payment for access to the very idea of privacy, communication, or autonomy.
12. Payment Systems
If the user decides to support the project financially, payment processing may be carried out through third-party payment systems and payment providers.
NỌX is not required to store directly and, as a rule, does not store full bank card payment details of the user if such data is processed by an external payment service.
By using a payment mechanism to support the project, the user independently acknowledges that the rules, terms, and policies of the relevant payment provider may apply to the payment itself to the extent that they relate to payment processing.
13. Refunds
Since support for NỌX is provided in the form of voluntary donations, such payments are generally non-refundable.
Exceptions may be considered only in the case of an obvious technical error, duplicate charge, or another clearly confirmed payment anomaly.
A refund request must be submitted through the contact details indicated on the website or in the About section within a reasonable time after the payment was made, with a description of the issue and any available supporting evidence.
A mere change of mind by the user after making a voluntary payment does not create an automatic right to a refund.
14. Contacts for Payment and Support Matters
For matters related to voluntary project support, erroneous charges, duplicate payments, payment confirmation, or other payment-related questions, the user may contact NỌX through the contact details indicated in the About section or on the project support page.
NỌX reviews such inquiries within a reasonable time, taking into account the nature of the issue, the information available, and the actual capabilities of the project.
15. Limitation of Liability
To the maximum extent permitted by applicable law, NỌX bears no responsibility for direct or indirect losses, loss of access, loss of compatibility, technical interruptions, actions of third parties, provider restrictions, blocking, filtering, errors of platforms, networks, browsers, operating systems, devices, hosting, routing, payment systems, or other external services affecting the use of the project or its individual components.
NỌX also bears no responsibility for the consequences of using or being unable to use the website, materials, downloads, communication solutions, experimental modules, external links, payment platforms, or other third-party services.
The user understands and assumes responsibility for their own decision to use the project, for the choice of environment of use, device, network, browser, operating system, software tools, and method of access.
16. External Services and Links
The NỌX project may contain links to external websites, platforms, tools, payment services, repositories, file distribution channels, or other third-party resources.
NỌX does not control the content, availability, security, relevance, behavior, limitations, or operating policies of such third-party resources and bears no responsibility for their actions or the consequences of their use.
Visiting an external resource, downloading from an external resource, using an external service, or making a payment through a third-party system is done independently by the user.
17. Modification, Updating, and Discontinuation of Project Parts
NỌX may at any time change, update, rework, move, restrict, suspend, or discontinue any parts of the project, website, structure, materials, downloads, visual appearance, communication solutions, or support mechanisms without prior notice, unless expressly stated otherwise separately.
The project develops according to its capabilities, technical conditions, infrastructure limitations, and strategic decisions, and therefore individual parts of NỌX may change, be supplemented, replaced, or discontinued.
18. Changes to This Document
NỌX may update this document from time to time.
The current version is published on the relevant page of the project. Continued use of the project after becoming familiar with the updated version means that the user independently decides to continue using NỌX on the principles set out therein.
If the user does not consider such principles acceptable, they must cease using the project and related materials.
19. Contact
For questions related to this document, the use of the project, or voluntary support of NỌX, the user may contact the project through the contact details indicated in the About section.
20. Final Provisions
This document is intended to describe the general principles governing the use of the NỌX project, its public and software components, and mechanisms of voluntary support.
If any provision of this document is found to be unenforceable or invalid, the remaining provisions shall continue to apply to the extent permitted by applicable law.
